TERMS & CONDITIONS

1. Delivery Time

  • On the eve of the following public holidays: Parcel Eagle will only provide delivery services from 1.00 pm to 5.00 pm.

  • Any deliveries made to the following destinations will be considered as Special Delivery: Jurong Port, Jurong Island, Cargo Agent Complex, Tuas, Keppel Distripark, PSA Distripark, Freight Forwarder, Onboard Vessel, Shipyard areas, Yacht Club (only to reception) and all government-restricted areas.

  • Home delivery services provided will be strictly for Dry goods only.

  • Parcel Eagle shall collect the Products from the respective CLIENT stores in and deliver the Products to the Customer in accordance to the terms of Agreement at location specified and/or instructed by CLIENT.

  • Service Provider shall ensure all delivery invoices are duly acknowledged with signature from the Customer and return the same to CLIENT with the billing tax invoice.

  • Operating Hours: Monday to Sunday: 0900 hrs to 2200 hrs (excluding Public Holidays)
     

2. Packing and Labelling

  • Every carton has to be packed in a reasonably strong case, wrapper or cover appropriate to its contents, and so that no part of the contents can be removed without either breaking or tearing the case, wrapper or cover or forcing two adhesive surfaces apart, or breaking a seal. 

  • All contents are to be adequately packed so as to protect against damage in the course of transmission and in particular, but not limited to:

  • The carton box which is of a fragile nature shall be packed in a container of sufficient strength and shall be surrounded in that container with sufficient and suitable material to protect the contents against the effect of such concussion, pressure and knocks to which it is ordinarily exposed in transmission, and the package shall bear the words FRAGILE HANDLE WITH CARE written conspicuously in capital letters on the face of the cover of the carton boxes;

  • The name, address and the telephone number of the sender and addressee are to be completed accurately. For packages that are addressed to companies, the name of the company, address, name of addressee and department/section in which the addressee is located must be provided to ensure prompt delivery of the package.

  • The Home Delivery Order Serial Number must be clearly indicated on all the Home Delivery Labels that are used to label the carton boxes.

  • The Home Delivery Information Record sheets are to be recorded clearly before any delivery collection.

  • By using our services hereunder, the Client warrants that the package submitted is acceptable for transportation. The Client agrees that the following are deemed unacceptable for shipment:-
    (i) Packages that are classified as hazardous material, dangerous goods, prohibited or restricted by the International Air Transport Association (IATA), the International Civil Aviation Organisation (ICAO), Postal regulations, any applicable government department or other relevant organization.

3. Ownership of the Products

  • Parcel Eagle Provider hereby acknowledges that The Client is the sole and exclusive owner of all Products. Parcel Eagle shall have no right, title or interests in any Products.


4. General Liability

  • Parcel Eagle shall not be liable for any loss or damage whatsoever arising from:
    A. the act or omission of THE CLIENT or any person acting on their behalf;
    B. compliance with the instructions given to Parcel Eagle by CLIENT or any other person entitled to give them;
    C. insufficiency of the preparation, packing, storage, labelling or marking of the Products except where such service has been provided by Parcel Eagle;
    D. handling, loading, stowage or unloading of the Products by THE CLIENT or any person acting on their behalf;
    E. inherent vice of the Products;
    F. riots, civil commotion, strikes, lockouts, stoppage or restrain of labour from whatsoever cause; or
    G    . any cause or event which Parcel Eagle could not avoid and the consequences whereof it could not prevent by the exercise of reasonable diligence.

  • Parcel Eagle shall not in any circumstances whatsoever and howsoever arising, including without limitation any negligence on the part of Parcel Eagle, its servants and/or agents be liable for loss or damage howsoever caused to property other than the Products themselves, indirect or consequential loss or damage, loss of profits, loss of market or the consequences of any delay or deviation.


5. Jurisdiction and Law

  • These terms and conditions as well as any claim or dispute arising out of or in connection with the Services of Parcel Eagle shall be subject to Singapore law and the exclusive jurisdiction of the Singapore courts.

  • All disputes, claim, question or disagreement arising out of, in relation to or in connection with this Agreement, or any breach thereof (Dispute) shall be settled through amicable consultation between both Parties.

  • Any Dispute that is not settled by consultation between the parties shall then be referred to mediation at the Singapore Mediation Centre (SMC) in accordance with the SMC rules in force. The mediation shall be conducted by one mediator appointed by the SMC.

  • Parties are only at liberty to proceed to submit to the courts of Singapore in the event that mediation fails. Mediation shall be deemed to have failed if there are no settlement of the Dispute within three (3) months of the first mediation session or when the Parties mutually agree in writing that mediation has failed.


6. Force Majeure

  • A party shall not be deemed to be in breach of these terms and conditions or otherwise liable by reason of any delay in performance or non-performance of any of its obligations under these terms and conditions to the extent that such delay or non-performance is due to an act of God or any other cause beyond such party’s reasonable control (including but not limited to any mechanical, electronic or communications failure).
